Section 1

Privacy Policy & Data Processing

Effective 1 October 2026 • Regulation (EU) 2016/679

MetricStreamPeak (“we”, “us”), located at Bartók Béla út 15, 1114 Budapest, Hungary, is the data controller for personal data processed through this website, our inquiry console, and our commercial correspondence. Questions regarding this policy may be directed to our dedicated mailbox at [email protected].

1.1 Categories of data collected. When you submit an inquiry through our console or contact us directly, we collect your full name, work email address, telephone number, company name, stated investment range, target go-live window, and the free-text description of your source systems and objectives. We additionally collect standard technical telemetry: IP address, user agent, referrer, and pages viewed.

1.2 Purposes and legal bases. Inquiry data is processed under Article 6(1)(b) GDPR for the performance of pre-contractual steps taken at your request. Technical telemetry is processed under Article 6(1)(f) GDPR on the basis of our legitimate interest in securing and improving the console. Invoicing and tax records are retained under Article 6(1)(c) GDPR to satisfy Hungarian statutory bookkeeping obligations.

1.3 Retention. Inquiry records are retained for 24 months from the last meaningful exchange. Contractual and accounting records are retained for 8 years as required by Hungarian tax legislation. Data is deleted or anonymized thereafter unless a longer statutory retention applies.

1.4 Processors and international transfers. We engage vetted processors for hosting, email delivery, and payment settlement, each bound by Article 28 data processing agreements. Primary storage resides within the European Union. Where a processor operates outside the EEA, transfers are governed by the European Commission’s Standard Contractual Clauses together with supplementary technical safeguards.

1.5 Your rights. You hold the rights of access, rectification, erasure, restriction, portability, and objection under GDPR Articles 15–21. You may withdraw consent at any time without affecting prior lawful processing. Requests are answered within 30 days and may be submitted to [email protected]. You may also lodge a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (NAIH).

1.6 Security. All transmissions are protected by TLS encryption. Access to inquiry records is restricted by role-based controls and multi-factor authentication. We never sell, rent, or distribute personal information to advertising brokers or data-resale marketplaces.

Section 2

Terms of Service

Governing all data engineering engagements by MetricStreamPeak

These Terms of Service (“Terms”) govern every engagement between the client and MetricStreamPeak, Bartók Béla út 15, 1114 Budapest, Hungary, including ingestion pipeline builds, transformation frameworks, analytical warehouse construction, streaming telemetry, dashboard delivery, migration projects, and Analytics Ops retainers.

2.1 Scope and statements of work. Each engagement is defined by a written statement of work (SOW) specifying deliverables, source systems, acceptance criteria, turnaround windows, and fixed pricing. In the event of conflict between these Terms and an executed SOW, the SOW prevails for the specific engagement.

2.2 Pricing and payment. Fixed-price slabs are quoted in US dollars or euros and invoiced according to the milestones stated in the SOW. Standard terms are 50% on kickoff and 50% on acceptance unless otherwise agreed. Retainers are billed monthly in advance. Invoices are payable within 10 calendar days and may be settled through the payment link provided in our navigation. Late balances accrue statutory default interest under Hungarian law.

2.3 Client responsibilities. The client provides timely access credentials, source system documentation, and a named technical contact. Delays in granting access or providing sample data extend delivery timelines on a day-for-day basis. MetricStreamPeak is not liable for defects originating in client-provided source data or third-party platform outages.

2.4 Acceptance. Deliverables are deemed accepted within 5 business days of handover unless the client submits a written defect notice describing reproducible failures against the acceptance criteria. MetricStreamPeak will remediate valid defects at no charge within the warranty window.

2.5 Intellectual property. Upon receipt of final settlement, all worldwide intellectual property rights in client-specific pipelines, transformation models, warehouse schemas, dashboards, and documentation are irrevocably assigned to the client. MetricStreamPeak retains ownership of its pre-existing frameworks, libraries, and accelerators, which are perpetually licensed to the client as an incidental part of delivery.

2.6 Confidentiality. Both parties will protect confidential information with at least reasonable care and will use it solely for the purposes of the engagement. Source credentials are stored in encrypted vaults and revoked at project close.

2.7 Service levels. Clients on an active Analytics Ops retainer receive a 99.97% pipeline uptime commitment measured monthly, a 2-hour response window for severity-one incidents, and weekly warehouse cost reporting. Credits for SLA breaches are applied to the following invoice as stated in the SOW.

2.8 Liability and termination. Either party may terminate an engagement for material breach with 14 days’ written notice if the breach remains uncured. Aggregate liability is limited to the fees paid for the engagement giving rise to the claim. Neither party excludes liability for fraud, wilful misconduct, or death or personal injury caused by negligence. These Terms are governed by the laws of Hungary, and the courts of Budapest have exclusive jurisdiction.

Section 3

Cookie Policy

How this website stores and reads data on your device

MetricStreamPeak uses cookies and similar local storage mechanisms on metricstreampeak.com to operate the site securely, remember your preferences, and understand aggregate usage of our inquiry console. This policy explains each category and how to control it.

3.1 Strictly necessary cookies. These items are required for core functionality: session integrity, CSRF protection, load balancing, and secure transmission. Because the site cannot function without them, they do not require consent under the EU ePrivacy Directive.

3.2 Preference storage. We store a single local storage key, cookie_accepted, on your device when you press Accept on our consent banner. This value records only your consent decision and is not transmitted to us or readable by third parties. Removing it through your browser settings reopens the banner.

3.3 Analytics cookies. Where enabled, analytics cookies measure page performance, console completion rates, and referring sources using aggregated, non-identifying metrics. These cookies are set only after affirmative consent and are never used to build advertising profiles.

3.4 Third-party embeds. Our contact page embeds a Google Maps frame. Google may set cookies when that frame loads; the frame is loaded lazily and can be avoided by contacting us directly by email or telephone. Payment interactions occur on our payment processor’s domain under its own cookie policy.

3.5 Managing cookies. You may block or delete cookies at any time through your browser controls. Blocking strictly necessary items may degrade console functionality. Withdrawing previously granted consent is as simple as clearing site data for this domain, and no alternative or punitive measures apply.

Section 4

Refund & Reimbursement Policy

Applies to fixed-price slabs, milestone engagements, and retainers

MetricStreamPeak sells fixed-scope data engineering engagements with predictable pricing. This policy sets out exactly when funds are returned and how cancellations are handled. Nothing in this policy limits mandatory consumer rights under Hungarian or EU law.

4.1 Cooling-off window. You may cancel a fixed-price engagement for a full refund of any amounts paid within 14 calendar days of the kickoff invoice, provided the build phase has not begun. If work has already started at your explicit request, we deduct the proportion of the fee corresponding to work actually completed, and remit the balance within 10 business days.

4.2 Milestone engagements. For multi-milestone SOWs, completed and accepted milestones are non-refundable. The current in-flight milestone is refunded on a prorated basis less any documented third-party costs already incurred, such as cloud provisioning or licensed tooling purchased on your behalf.

4.3 Retainers. Monthly Analytics Ops retainers may be cancelled at any time before the next billing date; the current month remains billable. Prepaid annual retainers are refunded prorated for whole unused months.

4.4 Non-performance. If we fail to meet an acceptance criterion in the SOW and cannot cure the defect within a reasonable period after written notice, you may terminate the engagement and receive a full refund of all fees paid for the affected scope, including the kickoff balance.

4.5 How to request a refund. Send your request from the email address on the original invoice to [email protected] with the subject line “Refund Request” and your invoice reference. We acknowledge every request within 2 business hours and settle approved refunds to the original payment method within 10 business days. Card and bank fees charged by processors are borne by us where the refund results from our non-performance; otherwise they are deducted at cost.

4.6 Invoicing. Outstanding invoices can be settled securely through the payment link in our navigation or by bank transfer; contact us for account details and remittance instructions.
